TRAINING AGREEMENT FOR HORSES

When the owner entrusts his horse to a trainer, he or she (understandably) expects a positive result. Ideally, in the (written) horse training agreement between the owner of the horse and the trainer, the achievement of a very specific training goal is explicitly agreed upon. Often the following questions arise in practice:

  • How precisely must the horse’s training goal be specified?
  • Does the owner of the horse have to continue to pay the training fee in the event that the horse is absent from training (for example, due to a shows or illness and/or injury)?
  • Does the trainer have to train the horse personally or may he also use assistants?
  • Is the trainer liable to the owner of the horse if damage occurs to the horse during training?
  • What if the horse causes damage to other people or property during training?
  • Can the owner and/or trainer terminate the training contract at any time?

The above questions can be discussed together in the course of a comprehensive and individual legal consultation and possible solutions can be identified. Ideally, details on the aforementioned topics are specified in the contract in order to avoid ambiguities and/or surprises later on.

IMPORTANT ASPECTS OF THE CONTRACT: TRAINING AGREEMENT

  • Contracting parties (details of the owner/authorized user of the horse as well as the trainer, contact details for emergencies, etc)
  • Information about the horse
  • Rights and duties of the trainer
  • Training objective/service description (scope of training, training content, equipment to be used, personal performance by the trainer, use of assistants, etc)
  • Obligations to warn and inform
  • Duties of care and custody
  • Duty to inform in case of injury and/or illness of the horse
  • Authorization of the trainer to hire a veterinarian and/or farrier
  • Obligations of the owner (payment obligation, obligation to continue payment in case of temporary absence/illness/injury of the horse, regulations in case of default of payment, etc)
  • Beginning, duration as well as possibilities of termination of the training contract
  • Insurance and liability (exclusion of liability/limitation of liability)
  • Other additional agreements
